When you submit an on-line or telephone order to YourCupz.com, your order is a conditional acceptance by YourCupz.com of your consent to purchase merchandise from us, and confirms your acceptance of our terms and conditions of sale as set forth below. You, the buyer and YourCupz.com agree that any contract entered into shall be interpreted and governed by the laws of the state of New York.
We cannot guarantee that all orders purchased from YourCupz.com will be 100% consistent in color and material. Minor variations in dye lots, material thickness and finish may occur in the manufacturing process. You understand that by placing your order with YourCupz.com you agree to accept the product with possible minor manufacturing variations.
Registration may have a variation of approximately 1/16”. Quality of offset printing due to the high printing speeds, resulting in slurring at the top and blurring towards the bottom of the imprint area. Ink coverage is thinner which can result in an imprint which may look transparent, especially on clear items. Dot gain in halftones is often up to 20%. Butt registration is allowed, however trapping is not. Please request random samples.
Pricing on our Website
We make the best effort to keep our website pricing current. However, from time to time, market conditions may change the price of a particular product. We reserve the right to change prices on the site at anytime. If a site price is not correct on an item that you order, we will contact you at once with the current price or help you choose a different item.
Shipping Delays and Transfer of Ownership Merchandise
YourCupz.com will not be held liable for any special damages or consequential claims that exceed the invoiced value of the merchandise purchased if the merchandise is not shipped on a specified date or is delayed in transit based on circumstances beyond our control. Our products are sold F.O.B. (freight on board) factory and are owned by the purchaser once they are picked up by the shipping company.
Cancellation or Changes to Existing Orders
We cannot guarantee that, once you have placed and approved an order with us, we will be able to make changes to or cancel your order without incurring charges. This will depend on the extent of work we have performed on your order. We will advise you in writing of any and all costs incurred prior to making changes or cancellations with us. You will be responsible for payment of those charges without dispute. Should you cancel your order with YourCupz.com prior to the commencement of production by us, you will be charged a processing fee for the work we have done to place your order into production plus proof charges if applicable.
Over & Unders
Products may be discarded during the manufacturing process that do not meet our factories' high standards. Sometimes extras are produced to ensure enough properly imprinted pieces to fill your order. We invoice for the exact quantity shipped. Usually the range is between 5% under and 5% over.
Payment is due in full prior to commencement of production. Credit card authorization and address verification must be received prior to processing the order form.
We are required to collect applicable sales tax for New York customers. If your company or organization is a nonprofit, we need a copy of your tax exempt certificate. If you use promotional products for resale, we need a copy of your resale certificate.
Any checks submitted for payment of our invoice(s) which are returned for insufficient funds will result in a charge of $50.00 to the entity we issued the subject invoice(s).
Return & Refund Policy
As you may be aware, custom printed products cannot be restocked. In fact, the industry standard for customized products dictates a no return and a no refund policy.
Your Use of Trademarks and Designs Submitted to YourCupz.com
You, individually, or any company ordering custom, imprinted merchandise from YourCupz.com warrants and represents that you are the sole, legal owner or licensee of all rights, including copyright, to each trademark, logo, statement, or any other intellectual property included in the design that you instruct us to imprint on the merchandise you purchase. You also warrant that the designs you approve for reproduction are in accordance with the guidelines of the owner of the trademark or logo. You warrant and represent there is no part of the design that violates or infringes upon the rights of any person or entity, and that there are no restrictions or rights of any kind or nature whatsoever which would prevent YourCupz.com from legally reproducing the images or text that you submit. You agree to defend, at your sole expense, any claim, suit, or proceeding brought against YourCupz.com for reproduction of the trademarks, logo or written information that you supply to us which causes wrongful use of any copyright, trademark, or other right of any third party. YourCupz.com shall not be held liable for the unauthorized, improper, or illegal use of any logo or trademark that is imprinted on promotional products purchased from us. YourCupz.com will not accept liability for the actions of customers who have misrepresented their ownership of licenses or trademarks. Also, you agree to indemnify and hold YourCupz.com harmless from any loss or damage associated with any such claim, suit or proceeding.
Reproduction of Trademarks and Logos on Our Website
All items shown on our web site that contain corporate logos or registered trademarks are shown only to illustrate the production capabilities of our company or other companies that produce the respective merchandise displayed on our site.
